According to Hogan, If the current appeal by the SEC takes its due course, ETF approvals usually come within six to twelve months, suggesting a mid-2025 approval, at the earliest. This is in connection with the timeline of events connected to the ongoing legal battle between Ripple Labs and the SEC.
The SEC sued Ripple in December 2020 alleging that XRP transactions were unregistered securities offerings. A subsequent U.S. court ruling determined that secondary market sales did not violate securities regulations, though sales to institutional investors did. The SEC is appealing parts of this decision, with a review scheduled for January 2025 Bitwise’s filing highlights the tough regulatory environment by counting the S.E.C. among an investor’s greatest risk factors.
Bitwise Chief Investment Officer Matt Hougan seemed optimistic about the proposal to list the XRP ETF, considering that his company only files once the chances of acceptance are good enough. According to him, “XRP is an attractive asset because of its strong technology and supportive community.”
